Truck Driver Tax Deductions & Per Diem (2026)

Taxes are one of the biggest costs in trucking, and most of it comes down to one question: are you an employee or in business for yourself? That answer decides almost everything below.

First: W-2 driver or owner-operator?

This is the fork in the road. The 2017 tax law suspended the deduction for unreimbursed employee expenses through 2025, so a W-2 company driver generally can't write off per diem or job expenses on a federal return. If that's you, the move is to have your carrier reimburse expenses or run a per-diem pay program instead.

An owner-operator or 1099 driver is running a business and files a Schedule C, so the write-offs below are fair game against business income. (See owner-operator vs. company driver for how the two really compare.)

The per diem rule

Drivers subject to DOT hours of service who are away from home overnight can use the IRS "special per-diem" meal rate instead of hoarding every meal receipt. The big perk: transportation workers may deduct 80% of the meal per diem, versus the 50% most taxpayers get. The daily rate is set by the IRS and changes periodically, so confirm the current-year figure before you file โ€” don't copy last year's number.

What you can't deduct

Everyday clothing, commuting from home to the yard, personal miles, meals when you're not away overnight, reimbursed expenses, and "lost income" during downtime aren't deductible. Mixing personal and business spending on one card is the fastest way to lose a legitimate deduction in an audit.

It all rides on records

Every deduction above is only worth what you can document. If your expenses and settlements live in a shoebox, you'll either overpay or scramble in April. Clean books also make your IFTA filing and your true overhead picture fall out automatically.

Frequently asked questions

Can company (W-2) drivers deduct per diem and expenses?

Generally no. The 2017 tax law suspended the unreimbursed employee expense deduction through 2025, so most W-2 company drivers can't write off per diem or job expenses on a federal return. Self-employed and owner-operators (Schedule C) still can. Check current rules with a CPA.

How does the trucker per diem work?

Drivers subject to DOT hours of service who are away from home overnight can use the IRS special per-diem meal rate instead of saving every meal receipt, and may deduct 80% of it โ€” a higher share than the 50% most taxpayers get. Confirm the current-year rate before filing.
